1. Introduction
Welcome to TurkCoach ("Company", "we", "our", "us")! These Terms of Service ("Terms", "Terms of Service") govern your use of our website located at www.turkcoach.com and our coaching services (together or individually "Service") operated by TurkCoach.
Our Privacy Policy also governs your use of our Service and explains how we collect, safeguard and disclose information that results from your use of our web pages. Please read it here: Privacy Policy.
By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms then you may not access the Service.
2. Coaching Services
TurkCoach provides professional business coaching services to individuals and organizations. All coaching relationships are established through formal agreements that outline the specifics of the coaching process, including confidentiality provisions, session frequency, duration, and termination procedures.
Our coaching services may include, but are not limited to, executive coaching, team coaching, business strategy coaching, and career development coaching. The exact nature and scope of services will be defined in your coaching agreement.
3. Communications
By creating an Account on our service, you agree to subscribe to newsletters, marketing or promotional materials and other information we may send. However, you may opt out of receiving any, or all, of these communications from us by following the unsubscribe link or instructions provided in any email we send.
4. Purchases and Payment
If you wish to purchase any product or service made available through the Service ("Purchase"), you may be asked to supply certain information relevant to your Purchase including your name, email, phone number, credit card number, credit card expiration date, and billing address.
You represent and warrant that: (i) you have the legal right to use any credit card(s) or other payment method(s) in connection with any Purchase; and that (ii) the information you supply to us is true, correct and complete.
Payment for coaching services is due according to the terms specified in your coaching agreement. TurkCoach reserves the right to refuse or cancel your order at any time for reasons including but not limited to: service availability, errors in the description or price of the service, error in your order, or other reasons.
5. Cancellations and Refunds
Coaching sessions may be rescheduled with a minimum of 24 hours notice. Sessions canceled with less than 24 hours notice will be charged in full, except in cases of genuine emergency at our discretion.
Our refund policy for coaching packages is specified in your coaching agreement. Generally, we offer a pro-rated refund for unused sessions if you decide to terminate the coaching relationship, minus an administrative fee as outlined in your agreement.
6. Intellectual Property
The Service and its original content, features and functionality are and will remain the exclusive property of TurkCoach and its licensors. The Service is protected by copyright, trademark, and other laws of both Turkey and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of TurkCoach.
Any materials provided to you as part of the coaching service, including assessments, worksheets, frameworks, and other tools, are the intellectual property of TurkCoach or its licensors and are provided for your personal use only. You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Service, except as follows:
- Your computer may temporarily store copies of such materials in RAM incidental to your accessing and viewing those materials.
- You may store files that are automatically cached by your Web browser for display enhancement purposes.
- You may print one copy of a reasonable number of pages of the Website for your own personal, non-commercial use and not for further reproduction, publication, or distribution.
7. Confidentiality
TurkCoach is committed to maintaining the confidentiality of all client information. We will not disclose any personally identifiable information or specific details about our coaching engagements without your explicit consent, except as required by law. Similarly, you agree to maintain the confidentiality of any proprietary methodologies, tools, and approaches shared with you during the coaching process.
For corporate coaching engagements, the specific confidentiality arrangements between the coach, coachee, and organization will be outlined in the coaching agreement.
8. Disclaimer Of Warranties
The Service is provided to you "AS IS" and "AS AVAILABLE" and with all faults and defects without warranty of any kind. To the maximum extent permitted under applicable law, TurkCoach, on its own behalf and on behalf of its affiliates and its and their respective licensors and service providers, expressly disclaims all warranties, whether express, implied, statutory or otherwise, with respect to the Service, including all implied warranties of merchantability, fitness for a particular purpose, title and non-infringement, and warranties that may arise out of course of dealing, course of performance, usage or trade practice. Without limitation to the foregoing, TurkCoach provides no warranty or undertaking, and makes no representation of any kind that the Service will meet your requirements, achieve any intended results, be compatible or work with any other software, applications, systems or services, operate without interruption, meet any performance or reliability standards or be error free or that any errors or defects can or will be corrected.
9. Limitation Of Liability
To the fullest extent permitted by applicable law, in no event will TurkCoach or its affiliates, or their licensors, service providers, employees, agents, officers or directors be liable for damages of any kind, under any legal theory, arising out of or in connection with your use, or inability to use, the Service, including any direct, indirect, special, incidental, consequential or punitive damages, including but not limited to, personal injury, pain and suffering, emotional distress, loss of revenue, loss of profits, loss of business or anticipated savings, loss of use, loss of goodwill, loss of data, and whether caused by tort (including negligence), breach of contract or otherwise, even if foreseeable.
10. Termination
We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.
All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.
11. Governing Law
These Terms shall be governed and construed in accordance with the laws of Turkey, without regard to its conflict of law provisions.
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.
12. Changes To Service
We reserve the right to withdraw or amend our Service, and any service or material we provide via the Service, in our sole discretion without notice. We will not be liable if for any reason all or any part of the Service is unavailable at any time or for any period. From time to time, we may restrict access to some parts of the Service, or the entire Service, to users.
13. Amendments To Terms
We may amend these Terms at any time by posting the amended terms on this site. It is your responsibility to review these Terms periodically. Your continued use of the Service following the posting of revised Terms means that you accept and agree to the changes.
